Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Mission ("Mission," "we," "us," or "our") governing your access to and use of our website at getmission.app, our purchase and checkout flow, and the Mission mobile application (together, the "Services"). By checking the agreement box, purchasing access, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the Services, and at least the age of majority to make a purchase. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.

2. The Service

Mission is an alarm application designed to help you get out of bed by requiring you to complete a physical task before your alarm is dismissed, and by keeping selected apps on your device locked until you finish that task. The Services are provided to support your morning routine and habits. You are responsible for using the Services safely and for setting alarms responsibly. Mission is not a medical, safety, or emergency device and should not be relied upon for any critical, medical, or safety-related purpose.

3. Accounts and Access Codes

When you purchase, we generate a unique access code tied to your email and send it to you. You are responsible for keeping your access code and email secure. Access codes are for your personal use and may not be shared, resold, sublicensed, or transferred. We may disable an access code that we reasonably believe has been shared, compromised, or used in violation of these Terms.

4. Purchases, Plans, and Billing

• Plans. We offer a recurring subscription plan and a one-time lifetime plan. The current prices and terms are shown at checkout.
• Founder pricing. "Founder" or early-access pricing is offered at our discretion and, where stated, is locked in for the applicable plan for as long as that plan remains active and in good standing. We may change pricing for new customers at any time.
• Payment. Payments are processed by our payment provider, Whop. By purchasing, you also agree to any applicable terms of the payment provider. You authorize us and our provider to charge your selected payment method.
• Subscriptions. Subscription plans renew automatically at the then-current interval until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. You remain responsible for amounts already due.
• Lifetime access. "Lifetime" means for the operational lifetime of the Mission application, which may end if we discontinue the Services. It does not create a perpetual obligation beyond the existence of the product.
• Taxes. Prices may not include taxes, which may be added where required.

5. Refunds

Except where required by applicable law, purchases are non-refundable once access has been delivered, because delivery of a unique access code is treated as immediate delivery of digital goods. If you believe you were charged in error, contact us at mat.voshchykov@gmail.com and we will review your request in good faith. Statutory rights that cannot be waived remain unaffected.

6. Pre-Launch and Availability

The Mission application may be in a pre-launch or early stage. By purchasing before launch, you understand that access will be delivered when the application becomes available, that timelines are estimates and may change, and that features may evolve. We do not guarantee any specific release date or that the Services will meet every expectation.

7. License

Subject to these Terms and your payment, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial use. You may not copy, modify, reverse engineer, decompile, distribute, resell, or create derivative works from the Services, except as permitted by law.

8. Acceptable Use

You agree not to: (a) use the Services for any unlawful, harmful, or fraudulent purpose; (b) attempt to gain unauthorized access to our systems, accounts, or data; (c) interfere with or disrupt the Services or their security; (d) share, resell, or circumvent access codes or payment; (e) scrape, harvest, or misuse data; or (f) use the Services in any way that infringes the rights of others.

9. Intellectual Property

The Services, including all software, text, graphics, logos, and the Mission name and branding, are owned by us or our licensors and are protected by intellectual property laws. These Terms do not transfer any ownership to you. All rights not expressly granted are reserved.

10. Third-Party Services

The Services rely on third parties, including our payment provider, backend, email, hosting, and the app stores. Your use of those services may be subject to their terms, and we are not responsible for their acts or omissions.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that alarms, notifications, or app-locking will always function as intended on every device or operating system.

12. Limitation of Liability

To the fullest extent permitted by law, Mission and its owner will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, sleep, opportunities, or goodwill, arising out of or relating to your use of or inability to use the Services, including any failure of an alarm to sound or an app to lock or unlock. Our total aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid to us in the twelve months before the event giving rise to the claim, or twenty United States dollars (US$20). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Mission and its owner from any claims, damages, liabilities, losses, and expenses, including reasonable legal fees, arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

14. Termination

We may suspend or terminate your access at any time if you violate these Terms or if we reasonably believe your use poses a risk to the Services or others. You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including payment obligations, disclaimers, limitation of liability, and indemnification.

15. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date, and continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws applicable at the place of the operator's residence, without regard to conflict-of-law rules. You agree that any dispute will first be raised with us in good faith by email so we can try to resolve it informally. To the extent permitted by law, you agree that disputes will be resolved individually and not as part of a class action.

17. Entire Agreement and Severability

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
